Local Government Regulations

When developing property in Kerr County, there are several layers of government and government agencies that regulate the development and establish rules of procedure.


Who has Jurisdiction?

Inside the city limits of Kerrville and the ETJ, the City of Kerrville has jurisdiction over subdivisions. Outside the ETJ, Kerr County has this authority. However, even if you meet the criteria for an exemption from Municipal Regulation, Kerr County is currently exercising authority over subdivisions int the ETJ for which the city has waived its platting requirement.

This is the statute that gives incorporated cities the authority to regulate development. It also outlines the exemptions that apply.

Local Government Code: Title 7: Chapter 232 - County Regulation of Subdivisions (PDF)
This statute grants similar power to county governments and also outlines exemptions.

These are the current regulations for subdivisions in Kerr County and the City of Kerrville. Note that the rules are subject to change, and we recommend discussing any questions with the County Commissioners or the City of Kerrville Development Staff.

According to the county commissioners, new rules have been adopted that are not available for the public to view. The rules posted here are the most current rules available to the public. We have requested a copy of the new rules, and they will be available for downlaod here as soon as we receive them.

Appendix to Kerr County Subdivision Regulations (PDF)
These rules are administered by the Kerr County Commissioners Court. Questions should be directed to the Kerr County Road & Bridge Department.

City of Kerrville Subdivision Regulations (PDF)
The City of Kerrville regulates subdivisions within the City as well as the City's Extra-Territorial Jurisdiction (ETJ). The ETJ extends one mile beyond the city limits of Kerrville. To see the current map of the city limits and ETJ, click here.

Texas Commission on Environmental Quality (off-site link)
The TCEQ Rules concerning on-site sewage facilities can be found at this link. Locally, these rules are administered by the Kerr County Environmental Health Department.
